NEW YORK, Nov. 17, 2014 /PRNewswire/ -- In what appears to be a horrific, unlikely accident, The New York Times has reported that a man was killed when a tape measure fell from a construction site and struck him (Falling Tape Measure Kills Man at Jersey City Construction Site, November 3, 2014). Near the Grove Street PATH in Jersey City, construction at 70 Christopher Street, one of the largest developments projects in the city, has been halted after a tape measure fell approximately 400 feet and killed a man who was stepping out of his vehicle. The deceased, Gary Anderson, had just arrived slightly before 9 a.m. to make a delivery of wallboard.
Above, a tape measure slipped from the belt of a construction worker and, tragically, struck Mr. Anderson in the head. He was taken to Jersey City Medical Center, where he died shortly thereafter. One construction worker was quoted as saying that a tape measure at a construction site was like a gun and should not be pulled out unless it is in use. The company working at the site, AJD Construction, told investigators it was their policy to require everyone on the property to wear a helmet and it is unclear why Mr. Anderson did not have one on. No conclusions have been released as of yet.
"First of all, our hearts go out to the friends and family of Mr. Anderson," said Adnan Munawar, Partner at Munawar & Andrews-Santillo LLP. "They have experienced a sudden, unexpected loss and we offer them our greatest condolences. No matter what the results of the investigation conclude, this accident goes to show just how dangerous construction sites are and why construction safety must be a top priority. While this accident seems highly unlikely, many things falling from such a height can become deadly and there is a reason protocols and regulations exist.
"As we wait for the results of the investigation to unfold, people should be reminded that if they or a loved one are ever injured on a construction site, that they likely are entitled to compensation and they should not hesitate to take the necessary steps to obtain it. Whether it is through workers' compensation insurance or through a private claim, exercising one's rights can be a complicated and overwhelming process, and it is definitely something one should do with the help of an expert. What you get with an experienced attorney is the piece of mind that your claim is being handled properly and that you have an advocate who knows how to fight on your behalf so that you can focus on recovering. Consulting with a personal injury attorney is free, and you never pay anything unless your claim is successful, so there should be no barrier for obtaining the help you deserve."
If you or a loved one has suffered an injury, medical condition, or worse, as a result of a construction accident in New York, you should contact a New York Construction Accident lawyer today at 212.400.4000 to receive information about your rights under the law and how to pursue claims for the compensation you deserve.
