IRVING, Texas, Nov. 20, 2017 /PRNewswire/ -- Nautilus Hyosung America, the largest and fastest growing ATM provider in the U.S., has filed a complaint today with the U.S. International Trade Commission (ITC) to enforce violation and remedial orders issued by the ITC against Diebold Nixdorf as a result of its infringement of Nautilus Hyosung patented technology.
The ITC findings on July 14, 2017 establish that Diebold Nixdorf's latest line of financial industry products, which incorporate its ActivMedia technology—specifically the 7700, 7780, 7790 and 9900 series ATMs—are barred from importation into and sale within the U.S.
"Despite the fact that the International Trade Commission issued clear orders preventing Diebold Nixdorf from importing and/or selling its ActivMedia technology in the United States, it continues to actively market and sell the infringing products to its customers," said Sungmahn Kim, Chief Operating Officer, Nautilus Hyosung America. "Rather than comply with the broad infringement findings and remedial orders, Diebold Nixdorf has ignored the ITC at every turn."
The invention in Nautilus Hyosung's U.S. Patent No. 8,523,235 ("'235 patent") was a major advancement in the industry— resulting in ATMs capable of processing and depositing mixed bundles of cash and checks. In its underlying investigation, the ITC ruled that Diebold Nixdorf's ATMs with ActivMedia modules infringe the '235 patent, and issued an exclusion order and cease-and-desist order to bar the importation and sale of these goods in the U.S.
