National Consumer Law Firm, 1-800-LAW-FIRM, PLLC Is Suing Garda, The Armored Car Company To Recoup Overtime Pay For Drivers Located Across The United States
SOUTHFIELD, Mich., April 2, 2013 /PRNewswire/ -- Overtime pay is supposed to start after 40 hours of work. That's just not happening at Garda according to drivers at several of their armored car locations. Allegedly, they have ignored and rewritten State and Federal laws, and only pay overtime after 50 hours of work. One by one, men and women who are past and present workers from the national company are coming forward from around the country to say that they, too, have been withheld overtime pay from Garda until they have reached the "50" hour minimum. The armored car company has over 180+ locations nationwide. States with a Garda office from coast to coast include: Arizona, Arkansas, California, Colorado, Delaware, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Louisiana, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, New Jersey, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, South Carolina, Texas, Utah, Vermont, Virginia, Washington, Wisconsin, and Wyoming.
Ari Kresch, CEO and founder of 1-800-LAW-FIRM, PLLC headquartered in Southfield, MI is suing Garda CL Great Lakes Inc., for withholding overtime premium pay from its workers who put in more than 40 hours and should receive premium pay according to the Fair Labor Standards Act (FLSA.) So far, lawsuits have been filed on behalf of drivers in Michigan and Ohio.
Garda is being held accountable by current and former workers for:
(i) |
Unpaid wages from defendant for overtime work for which they did not receive overtime pay as required by law, and |
(ii) |
Liquidated damages pursuant to the FLSA, 29 U.S.C. 201 et seq., because defendant's violations were willful. |

Plaintiffs typically would work over 40 hours per week, with schedules varying at times - working as much as 60 hours in a week. Garda routinely would pay the overtime rate after 50 hours worked. Kresch points out that this is a direct violation of the FLSA and the Department of Labor Regulations.
1-800-LAW-FIRM, PLLC is requesting jury trials so that Plaintiffs and the Collective Action Members, encompassing other employees can be entitled to recover from Garda their unpaid overtime compensation, etc.
