NEW YORK, Jan. 7, 2014 /PRNewswire/ -- Mirena IUD lawsuits (www.themirenalawsuitcenter.com) continue to mount in courts around the country, Bernstein Liebhard LLP reports. Most recently, a woman from Sioux Falls, South Dakota filed the state's first Mirena lawsuit after she allegedly suffered injuries following spontaneous migration of the device. According to her complaint, which was filed on December 20, 2013 in U.S. District Court, District of South Dakota, the Plaintiff was forced to undergo Mirena removal surgery in 2010 after the device became lodged in her pelvic cavity. Among other things, the complaint alleges that Bayer Healthcare Pharmaceuticals downplayed the health and safety risks associated with Mirena. (Case No. 4:2013cv04143)

According to the South Dakota lawsuit, the complaint could be transferred to U.S. District Court, Southern District of New York, where nearly 300 Mirena IUD lawsuits have been consolidated in a multidistrict litigation for pretrial proceedings. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434.) Another 300 claims have been filed in a multicounty litigation currently underway in New Jersey's Bergen County Superior Court. (In Re: Mirena Litigation; Case No. 297) All of the complaints were filed on behalf of women who allegedly suffered uterine perforations, infertility, organ damage, and other serious Mirena complications due to spontaneous migration of the device, even though their IUD had been correctly inserted by a healthcare provider. All of the lawsuits point out that Mirena's label does not warn about spontaneous migration of the IUD, but only states that migration may occur if the uterus is perforated during insertion.
The Mirena IUD was brought to market in 2000. Since then, the U.S. Food & Drug Administration (FDA) has received more than 70,000 adverse event reports implicating Mirena, including many that involve device dislocation and uterine perforation. The FDA issued Bayer a warning letter in 2009, after finding that one of its Mirena promotions overstated the benefits associated with the IUD and understated its risks.
