NEW YORK, Nov. 2, 2017 /PRNewswire/ -- Car dealer launches nationwide suit accusing CDK Global, LLC ("CDK") and The Reynolds and Reynolds Company ("Reynolds") of federal and state antitrust violations, and seeking damages and injunctive relief for a class of automobile dealers.
The complaint was filed on October 19, 2017, in the United States District Court for the District of New Jersey, and alleges that defendants engaged in a conspiracy allocating market share, reducing competition, and fixing, raising, maintaining and/or stabilizing prices in the market for the provision of data management systems ("DMS") to the retail automotive industry and in the related subsidiary market for the provision of services for extracting, formatting, integrating, and organizing the data housed on the DMS.
Defendants dominate the DMS industry, and control approximately 75 percent of the United States market for the supply of DMS by number of dealers, and approximately 90 percent when measured by vehicles sold. The complaint alleges a conspiracy between CDK and Reynolds consisting of a continuing agreement, understanding or concerted action to eliminate competition in the DMS market and the data integration services market. According to the complaint, by seizing control over access to dealer data, CDK and Reynolds have been able to impose massive price increases for their data integration services and obtain monopoly profits.
Defendants' conduct is alleged to violate several provisions of the federal Sherman Antitrust Act, and the New Jersey Antitrust Act on behalf of a nationwide class of dealers and a New Jersey dealer class, respectively.
