RENO, Nev., April 18, 2016 /PRNewswire/ -- On April 18, 2016, Stipulated preliminary injunction orders defendants Metalast International, Inc., Metalast, Inc., David M. Semas, Greg D. Semas, and Wendi Semas-Fauria from engaging in specified activities with regard to CHEMEON's trade secrets, confidential information, copyrights, and patents.
The Stipulated Order filed in Case 3:15-cv-00294-MMD-VPC on March 28, 2016, in the United States District Court for the District of Nevada, enjoins (prohibits) defendants David M. Semas, Greg D. Semas, Wendi Semas-Fauria, Metalast, Inc., Metalast International, Inc. and their shareholders, directors, members, managers, employees, and all those having knowledge of the injunction and being active in concert with any of them, from:
- Disclosing or utilizing any information known to constitute a trade secret or the confidential information of Metalast International, LLC or CHEMEON; the Order identifies CHEMEON trade secrets regarding CHEMEON AA-200™, CHEMEON TCP-HF™, and CHEMEON Process Control Hardware and Software;
- Reproducing, distributing, deriving from, or otherwise infringing any CHEMEON work of authorship, or any copyrights whether or not registered with the United States Copyright Office, known to be owned by Metalast International, LLC or CHEMEON including any works of authorship or copyrights in business plan descriptions, pro forma financial information, and photographs identified in the Order; and
- Practicing or otherwise infringing any patent owned by CHEMEON, including without limitation, Patent No. 8,486,203, or practicing any other patent under a claim of sub-license from CHEMEON.
The stipulated preliminary injunction is a result of the June 3, 2015 complaint filed by CHEMEON Surface Technology, LLC, alleging and detailing the threatened misuse or infringement of certain CHEMEON trade secrets, confidential information, copyrights, and goodwill, including without limitation the goodwill it acquired pursuant to its acquisition of all assets of Metalast International, LLC. On March 31, 2016, the Nevada District Court also denied a counter-motion by Defendants David Semas and Metalast International, Inc., for a preliminary injunction against CHEMEON seeking to prevent CHEMEON and its distributors from marking any CHEMEON product with the phrase "formerly Metalast" or "formerly known as Metalast." CHEMEON changed its name from Metalast Surface Technology, LLC, to CHEMEON Surface Technology, LLC, in March 2015, and terminated the use of the word "Metalast" as its trademark on June 9, 2015.
