MERC Bench Decision: Wayne County Was Wrong, Must Pay Workers
DETROIT, March 5 /PRNewswire-USNewswire/ -- Albert Garrett, President of Michigan Council 25 of the American Federation of State, County and Municipal Employees (AFSCME), AFL-CIO, issued the following statement:
"We have received a bench decision from Administrative Law Judge (ALJ) David M. Peltz of the Michigan Employment Relations Commission (MERC) in the matter of Annual Service Adjustments (ASA) which Wayne County refused to pay employees beginning in June, 2009," stated Garrett.
"Mr. Peltz ruled that Wayne County had repudiated the collective bargaining agreement when they failed to provide the two percent ASA in June, 2009," added Robert Fetter, attorney with Miller Cohen, PLC, who represented AFSCME in the matter.
"The decision applies to about 1,600 non-supervisory employees in AFSCME Wayne County local unions," continued Fetter. "Mr. Peltz will order back pay from the date on which the ASA was due."
"AFSCME had agreed to waive the ASA for a period of time, but the parties had agreed the ASA was to be paid in 2009. When the time came, the County refused to pay," added Garrett. "This was disingenuous of them, to say the very least.
"The Union has done, and is doing, our part in Wayne County," Garrett concluded. "It is difficult to bargain with somebody who agrees to a provision, then refuses to live up to it. This decision helps to rectify the damage done to these dedicated employees by Wayne County's intransigence."
