Media Advisory Issued by O'Melveny & Myers LLP on Behalf of SK hynix
LOS ANGELES, May 9, 2013 /PRNewswire/ -- SK hynix is issuing the following statement following US District Judge Ronald M. Whyte's ruling yesterday. Please attribute it to an SK hynix spokesperson:
SK hynix believes that the appropriate sanction for Rambus Inc.'s bad faith prejudicial destruction of evidence is, as other courts have found, prohibiting Rambus from enforcing its patents. Judge Whyte found that Rambus destroyed evidence in preparation for its litigation campaign against SK hynix, and his ruling yesterday imposed a US$250 million sanction against Rambus. However, SK hynix believes that Rambus's now-expired patents - which the Patent and Trademark Office has also held are invalid - are not valid or enforceable. SK hynix will appeal this ruling to the Court of Appeals for the Federal Circuit.
