Medbox, Inc. Comments on California Supreme Court Decision
Case affirms the legality of medical marijuana sales and distribution in the state
HOLLYWOOD, Calif., Jan. 22, 2013 /PRNewswire/ -- Medbox, Inc. (OTC Markets: MDBX) (www.medboxinc.com), commented on the recent California Supreme Court decision that denied a review of a landmark medical marijuana case, which has drawn widespread attention from prosecutors and policymakers across the state.
The case stems from a 2010 prosecution of the owner of a medical marijuana dispensary in San Diego. The conviction was overturned by the Fourth District Court of Appeal, and last week the California Supreme Court decided to not review the case – effectively ending any further attempts at prosecution.
Notably, the State Supreme Court took the additional action of refusing to depublish the lower courts findings, thereby affirming the legality of medical marijuana sales in California.
"This is a clear declaration that medical marijuana is here to stay in California," according to Dr. Bruce Bedrick, CEO of Medbox, Inc. "The court has ruled that safe access to medical marijuana is a patient's right, and we support that decision. To date, while we have many machine placements in the state of California, we have taken a conservative approach to expanding our market reach due to conflicting regulations and legal opinions in the state. This recent development will give us the confidence we need to move forward in helping clients setup new clinics without the fear of criminal prosecution."
In related news, the City of San Diego effectively declared an end to their war on medical marijuana with a letter from Mayor Bob Filner ordering civil prosecutors to stop the crackdown on dispensaries.
In the letter sent to the police chief, city attorney and the city's Neighborhood Code Compliance Department, Filner instructed the departments to halt all prosecutions of city zoning code violations of medical marijuana dispensaries.
The City Attorney responded to Filner's call for an end to the prosecutions in a letter that said, "We will, of course, comply with that direction."
Medbox is noted for being able to work with city planners, attorneys and supervisors, to create medical marijuana dispensaries that are fully compliant, secure, and transparent in their operation and reporting. As a result of the Mayor's announcement, Medbox will be actively assisting clients with permitting and technology needs in San Diego, in concert with the City.
"We hope to talk to city officials in San Diego in the near future, as well potential operators of medical marijuana dispensaries, as part of our commitment to legitimizing authorized use of the product and creating a balanced and properly regulated industry," Bedrick said.
