Mantese Honigman Rossman and Williamson and John J. Conway Appointed Interim Lead Class Counsel in Class Action Alleging Blue Cross of Michigan Has Charged Hidden Fees
TROY, Mich., Nov. 5, 2014 /PRNewswire/ -- On October 31, 2014, United States District Judge Mark A. Goldsmith appointed Mantese Honigman Rossman and Williamson, P.C. and John J. Conway, P.C. Interim Lead Class Counsel in a putative class action lawsuit brought by participants and beneficiaries of self-funded health plans asserting that Blue Cross breached its fiduciary duties by charging hidden fees to hundreds of employer funded health plans in Michigan. Plaintiffs are seeking a judgment that would require Blue Cross to repay all the allegedly hidden fees charged.
According to the Complaint, Blue Cross reported a low administrative fee to its customers to give the illusion that its administrative costs were competitive with other third-party administrators. Blue Cross then hid additional administrative fees in the amounts it reported as hospital claims costs. The suit alleges that Blue Cross kept the difference between what it was actually paying for employee health care claims and what it reported it was paying for claims. The Complaint alleges it was Blue Cross' policy to charge these hidden fees to all employer self-funded plan customers in Michigan and therefore the lawsuit should proceed as a class action on behalf of all such plans.
