BIRMINGHAM, Mich., Oct. 1, 2015 /PRNewswire/ -- Attorney Daniel J. McCarthy, a member of the Birmingham law firm of Lippitt O'Keefe Gornbein, PLLC, has successfully argued for the dismissal of 11 lawsuits against a former Wayne State University student for payment of student-loan debts totaling more than $120,000.00.
The suits were filed in the 46th District Court in Southfield, Michigan, nine months ago by National Collegiate Student Loan Trust. In an important decision that could affect hundreds if not thousands of student-loan lawsuits throughout the United States, the court dismissed the cases last month.
"Our client originally tried to navigate the complex court system on his own," McCarthy said. "But by May 2015, he realized that professional representation was needed and turned to our firm for help. I implemented an immediate legal strategy which led to the ultimate dismissal of the entire litigation."
The student in question attended Wayne State University from 2002 through 2008, obtaining both bachelor's and master's degrees in engineering. Like many students, he accumulated private and public loans while in school.
According to McCarthy, the student's loan documents were confusing because the original applications for both public and private loans were "practically identical." After graduation, the student began paying back his loans and was led to believe that his payments covered all of his loans, but later found out that they did not.
"Unbeknownst to our client, his monthly payments were credited only to repay his federal loans, not his private loans," McCarthy said. "Of course, this was not our client's fault. The bank originating the private loans apparently sold the loans to a third party before the ink was dry on the loan application."

In my client's case, National Collegiate did not produce sufficient documentation to even prove that it owned the right to collect any money whatsoever. When National Collegiate filed 11 separate lawsuits, it was nothing more than a bullying tactic in an attempt to get my client to settle. We refused to allow that to happen."
