Legal-Bay Lawsuit Settlement Funding Reports Zimmer NexGen Knee Bellwether Trial to Begin October 13th, 2015
Lawsuit Cash Advance Firm says that just as the Zimmer NexGen Knee cases are headed towards a bellwether trial, yet another knee product from Zimmer - the Persona product - has now also been recalled.
ATLANTA, June 30, 2015 /PRNewswire/ -- Legal-Bay LLC, the Lawsuit Settlement Funding Company, announced today that the first bellwether trial in the multidistrict litigation (MDL) over the Zimmer NexGen Knee implant lawsuits has been scheduled to begin October 13th, 2015. There are currently more than a thousand cases against Zimmer Inc. which have been consolidated before a federal judge in Illinois. The judge issued that the first bellwether trial will begin in October of this year. Zimmer Inc. previously issued voluntary recalls for its metal-on-metal hip device – the Durom Cup (in 2008) – and another recall in 2010 for its NexGen MIS Tibial Components. Both recalls led to lawsuits which are currently pending in a federal multidistrict litigation (In Re: Zimmer Durom Hip Cup Products Liability Litigation, MDL No. 2158) and the MDL in question in Illinois (In Re: Zimmer NexGen Knee Implant Products Liability Litigation, MDL No. 2272).

In addition to the first bellwether trial announcement, another recall has been made. The FDA recently announced a Class II recall for Zimmer's Persona Trabecular Metal Tibial Plate knee implant, affecting all lots and sizes of the knee implant. According to the FDA's website, this affects all 11,658 devices that were recalled. Also according to the FDA, Zimmer Inc. initiated a voluntary recall of its Persona Trabecular Metal Tibial after there was an increase in complaints of loosening and radiolucent lines. All sizes and lots of the affected devices will be removed from the market and will no longer be distributed.
Patty Kirby, COO and Head of Client Relations, commented on the Zimmer cases, "The Zimmer knee products have been subject to many lawsuit claims over the years. The end does not look in sight with the NexGen product beginning bellwether trials, while the Persona product has now started a new recall and possibly an entirely new litigation cycle for Zimmer knee implant patients."
