Stryker also made headlines this month when a former head of a Stryker Corporation subsidiary pleaded guilty to fraud. According to NorthJersey.com, charges were placed against him alleging that he "sold unapproved surgical tools used for knee replacements to surgeons around the country." California-based OtisMed Corporation was bought by Stryker in 2009, after the fraudulent transactions occurred, but according to NorthJersey.com, "Stryker's OtisMed unit agreed to pay $80 million in criminal and civil penalties after pleading guilty to a felony charge." The former chief executive officer of OtisMed who was charged and pleaded guilty to three misdemeanor fraud counts, Charlie Chi, will be sentenced on March 18th and faces up to three years in prison.

Here is an update on the major hip litigations provided by Legal-Bay:
- Stryker Rejuvenate Hip Stem and the ABG II Modular-Neck Hip Stem Update: Stryker Corporation agreed to pay $1.43 billion to settle thousands of hip implant lawsuits filed against them. The settlement is expected to deliver awards in amounts of $10K to $600K for serious complications. The settlement was announced Monday November 3rd, both in the Bergen County courthouse before Superior Court Judge Brian Martinotti and in the U.S. District Court in St. Paul, Minnesota. Those who have received the devices in question, the Stryker Rejuvenate and ABG II hip replacement devices, and consequently had them removed are eligible to participate in the settlement; however, those who sued prior to device failure without replacement surgery before November 3rd are not qualified to participate in the settlement at this time; however, according to lawyers close to the situations, they "could be covered in a future round of negotiations." Legal-Bay expects the settlement to be approved within the upcoming months, however, disbursement of funds isn't probable until mid-2015 or later. Both the Rejuvenate hip stem and the ABG II have been recalled, but the Stryker Accolade hip has not; Legal-Bay continues to fund these cases regardless.
- Wright Conserve/Profemur Update: According to an updated Case List issued September 15th, 2014, approximately 800 claims have been filed against Wright Medical Technology Inc. relating to their Conserve hips in state and federal courts throughout the U.S. The filings are growing, and the plaintiffs involved have had Wright Conserve hips as well as Wright Profemur hip replacements. The cases are underway in a multidistrict litigation in the U.S. District Court in the Northern District of Georgia. The first bellwether trial could began as early as March 2015.
- Biomet M2a Magnum Hip Implant Update: The multidistrict litigation in the U.S. District Court for the Northern District of Indiana began in 2012 and Biomet Inc. reached a $56 million settlement in February of 2014 for an average of $200K per hip. Legal-Bay is providing settled case funding on these cases that are included in the first settlement wave, and pre-settlement funding on any new claims still pending.
- J&J/DePuy ASR and Pinnacle Hips: ASR Settlement was reached for approximately 7K claims, and another reported 1K cases are about to be settled for a base award of $250K per case. However, this leaves 25% of the cases still pending, still with time for ASR claims to be filed in many jurisdictions. Pinnacle hip cases remain unresolved and DePuy has been victorious in its first bellwether trial, in which the plaintiff walked away with no award. The bellwether trial took place in the U.S. District Court for the Northern District of Texas under Judge Ed Kinkeade. There are still 6,500 cases pending relating to the company's Pinnacle hip implant device, and the next trial is scheduled for January.
