Legal-Bay Lawsuit Settlement Funding Reports Rise in Zimmer Knee Lawsuit Filings
Case Funding Firm says that they have increased their funding amounts for victims of Zimmer Knee implant complications due to the growing number of lawsuits being filed against Zimmer Inc.
INDIANAPOLIS, Dec. 9, 2014 /PRNewswire/ -- Legal-Bay LLC, the Lawsuit Settlement Funding Company, announced today that they've increased funding amounts on all Zimmer Knee cases due to the increasing number of lawsuits that continue to be filed against Zimmer Inc., one of the leading manufacturers of knee implants in the marketplace. The knee implant devices were designed to increase range of motion and imitate natural knee function, but plaintiffs who have filed cases against Zimmer Inc. claim that the devices actually caused a range of complications such as: decreased range of motion, extreme pain, tissue and/or nerve damage, bone degradation or fractures, instability, infection, blood clots, and ultimate failure of device implant. Also, revision surgery was often required. The Zimmer NexGen Flex devices have been implanted in approximately 150K patients. There are currently over 1,000 filed lawsuits against Zimmer Inc. in state and federal courts throughout the U.S. and Legal-Bay expects this number to continue to rise as more and more patients notice product defects and complications. Federal lawsuits have been consolidated into multidistrict litigation (MDL) in the U.S. District Court in the North District of Illinois, with the first bellwether trial set to begin in 2015.

In 2010, the U.S. FDA issued a Class II recall to Zimmer Inc. over the NexGen Complete Knee Solution MIS Tibial Components, Locking Screw and Stem Extensions, affecting 68,383 devices that had already been implanted. Recalls were issued for various components of the NexGen knee mechanisms (the NexGen LPS femoral component, the NexGen LPS Flex gender femoral component, and the NexGen MIS tibial components). In addition to the FDA Class II recall, Zimmer Inc. made a voluntary recall regarding the NexGen MIS Tibial Component, because according to drug watch, "one of the pieces could loosen or fail because of shoddy manufacturing." The voluntary recall that was initiated affects 41,180 devices and includes eight sizes (1-8).
Patty Kirby, COO and Head of Client Relations, commented on the rise of lawsuits against Zimmer Inc., "Although this litigation is one that we have been involved with for the last couple of years, our investors and underwriters are now prepared to approve these cases at a greater rate and for substantially more cash advance value than in the past due to the rise of filings we are seeing in the courts."
