Endo has agreed to pay nearly $1.3 billion in order to resolve product liability transvaginal mesh lawsuits over their implants. The devices were designed to support pelvic muscles and treat incontinence; however, the lawsuits claim that the line of vaginal mesh implants caused injury through erosion in the vagina for some women, leaving them in pain with potential exposure to serious infection resulting in required revision surgery. The settlement was announced after the U.S. FDA stated that the vaginal mesh inserts needed stricter safety requirements, as they are high-risk devices. In June of 2013, Endo had paid $54.5 million to resolve an undisclosed number of lawsuits regarding their devices. Now, according to Endo, they have settled nearly all of the remaining suits over their Perigee, Apogee, and Elevate mesh implants. The current deal settles more than 10K lawsuits, and before this, they agreed to pay approximately $830 million to settle an additional 20K suits. Both deals have average settlement amounts in the $40K to $50K range; however, Legal-Bay's sources close to the litigation believe many cases with serious complications and revision surgeries could result in settlement values up to $400K.
