NEWARK, N.J., Sept. 18, 2015 /PRNewswire/ -- MT Services LLC, a Lawsuit Settlement News Reporting Company which operates lawsuitsettlementnews.com, reports today the major hip settlements, verdicts, and litigation updates.
- Wright Medical Technology Inc.: A recent $4.5 million verdict was reached against Wright Medical Technology Inc. over their Profemur R hip implant by jurors in Los Angeles County Superior Court. Currently, Wright Medical Technology Inc. faces more than 1,000 lawsuits over their hip implants. The majority of the cases have been coordinated for pretrial proceedings in either the LA County Superior Court or the U.S. District Court for the Northern District of Georgia where the multidistrict litigation (MDL) is taking place (MDL 2329). Bellwether trials are set to begin this year.
- Stryker Corporation: Stryker settled for $1.43 billion to settle thousands of hip implant lawsuits against them. The settlement was announced November 3rd, 2014, both in the Bergen County courthouse before Superior Court Judge Brian Martinotti and in the U.S. District Court in St. Paul, Minnesota. Those who have received the devices in question, the Stryker Rejuvenate and ABG II hip replacement devices, and consequently had them removed, are eligible to participate in the settlement; however, those who sued prior to device failure without replacement surgery before November 3rd are not qualified to participate in the settlement at this time. According to lawyers close to the situations, it is expected that individuals with revisions after November 3rd, 2014 "could be covered in a future round of negotiations." The settlement is expected to deliver awards in the amounts of $10K to $600K for serious complications.
- BioMet Inc.: BioMet settled for $56 million over its BioMet M2a 38 or M2a Magnum hip replacement system, resulting in settlement awards of approximately $200K per hip cases that required revision surgery.
- DePuy Orthopaedics: DePuy, a division of Johnson & Johnson, reached a global settlement in late 2013 for close to 7,000 claims with an average settlement value or approximately $250K per hip implant revision. The settlement was for the DePuy ASR hip. The DePuy Pinnacle Hip model has basically the same metal-on-metal components of the ASR hip model, however, the Pinnacle hip continues to be sold despite thousands of lawsuit claims in state and federal courts throughout the U.S. Victims who may have elevated chromium and cobalt levels in their blood, have required a revision surgery, or have had issued with their Pinnacle hip are encouraged to seek legal counsel immediately.
Chris Janish, CEO of MTS commented on the major hip settlements and verdicts, "The Wright hip verdict is a substantial award that has been very consistent with the other hip litigations that started with bellwether trial losses for the defendants and then ultimately large settlements. Wright continues to defend themselves in the litigation and will most likely appeal the recent large verdict, so there is a long way to go for plaintiffs to receive any funds through a final resolution."
