Lawsuitsettlementnews.com Reports $72MM Jury Award Against J&J for Cancer Death Linked to Talcum-Based Powder
Lawsuit Help Website says that a Missouri state jury ordered Johnson & Johnson to pay $72 million in damages to the family of a woman whose death from ovarian cancer was linked to her continual use of J&J's talcum-based Baby Powder and Shower to Shower.
NEWARK, N.J., April 5, 2016 /PRNewswire/ -- MT Services LLC, a Lawsuit Settlement News Reporting Company which operates lawsuitsettlementnews.com, reported today that a Missouri state jury recently ordered Johnson & Johnson to pay $72 million in damages to the family of a woman whose death from ovarian cancer was linked to her continual use of J&J's talcum-based Baby Powder and Shower to Shower.
The woman who died, Jacqueline Fox, had claimed that she used the J&J Baby Powder and Shower to Shower "for feminine hygiene for more than 35 years before being diagnosed three years ago with ovarian cancer." She died at the age of 62.
The verdict was announced in the circuit court of St. Louis, with the jury awarding Jacqueline Fox's family $10 million in actual damages and $62 million in punitive damages. According to an article in Reuters, the family's lawyers said "Jurors found Johnson & Johnson liable for fraud, negligence and conspiracy." This was the first verdict by a U.S. jury to award damages over the claims against J&J.
The Shower to Shower brand is now owned by Valeant Pharmaceuticals International Inc., however, they were not a defendant in Fox's case.
There are approximately 1,000 cases that have been filed in Missouri state court, with an additional 200 in New Jersey. The claims allege that Johnson & Johnson "failed for decades to warn consumers that its talc-based products could cause cancer."
There are several other trials over talc lawsuits set to begin later this year.
Chris Janish, CEO of MTS, commented on the recent jury verdict, "As this is the first U.S. jury verdict in which damages were awarded over the talc claims, the award was substantial and seems like it could give hope to other plaintiffs out there with similar claims. We encourage anyone with similar claims to seek legal counsel as well."
