According to court documents, an estimated 150,000 patients have been implanted with the NexGen Flex devices, and over 1,000 Zimmer Knee lawsuits are currently pending across the country; however, MTS expects these numbers to rise as more knee implants begin to fail. Starting in 2010, the FDA issued recalls for various components of the NexGen knee mechanisms (the NexGen LPS femoral component, the NexGen LPS Flex gender femoral component, and the NexGen MIS tibial components), however, none of the models have been permanently removed from the marketplace. An estimated 50K knee replacements are believed to be directly affected by the recalls. Federal lawsuits have been consolidated into multidistrict litigation (MDL) in the U.S. District Court in the North District of Illinois, with the first bellwether trial set to begin in 2015.
