Lacks Home Products Lawsuit Against Home Depot Advances
GRAND RAPIDS, Mich., Nov. 2, 2016 /PRNewswire/ -- The Federal District Court for the Eastern District of Michigan ruled that Lacks Home Products, LLC, may continue its lawsuit against Home Depot for breach of contract and unfair competition.
The lawsuit alleges that Home Depot breached its license to manufacture Lacks' patented products, provided false accountings of royalties owed Lacks, and committed unfair competition by offering confusingly similar and inferior products. The license was originally granted to settle a lawsuit when Lacks sued Home Depot for patent infringement related to Lacks' Coach House Accents® products.
Coach House Accents is a line of garage door enhancement products, including attractive simulated window panels, handles and hinges that improve the curb appeal of any home for a reasonable cost. Soon after Lacks launched its patented products, Home Depot's HD Supply subsidiary contracted a Chinese manufacturer to develop a nearly identical product, but with alleged inferior materials and quality.
