L.A. Judge Admits Fraud Upon the Courts: Full Disclosure Network Report®
WASHINGTON, July 19 /PRNewswire-USNewswire/ -- The Full Disclosure Network® released a report today that California State Superior Court Judge David Yaffe has admitted in court documents to "false information" filed in the contempt of court case of attorney Richard I. Fine who has been held in solitary "coercive confinement" for civil contempt of court for over a year and five months. According to new documents filed just last week, Judge Yaffe has reversed his previous Minute Orders saying that, "the Court never intended to find that Richard Fine did not have standing" to challenge him from sitting as Judge on the case." It was not until Richard Fine filed a "Fraud Upon The Court" action with the U.S. District Court and U.S. Supreme Court the that new documents appeared in the Court Docket Read the Full Report at URL http://blog.fulldisclosure.net/2010/07/richard-fine-judge-yaffe-admits-fraud.html
ISSUE: Should Judge Yaffe Have Recused Himself?
A Ninth Circuit Court of Appeals Justice Andrew Kleinfeld issued a Certificate of Appealability to Richard Fine on the single issue as to whether or not the Trial Court Judge (Yaffe) should have been disqualified. Based on the new documents filed by Yaffe one could speculate that the Ninth Circuit Court of Appeal and the U.S. District Court might have had a different outcome had they the complete, accurate documentation been before them. http://blog.fulldisclosure.net/2009/08/richard-i-fine-appeal-rights-restored.html
AT ISSUE: FALSE STATEMENTS BY THE COURT
In a letter to the U S Supreme Court dated July 15, 2010 Dr. Fine cites two new Minute Orders filed in Yaffe's Court almost two years late that describe the false statements presented to the Federal District Court and the U.S. Supreme Courts prepared by Judge Yaffe and his attorney Kevin Mc McCormick that misled the higher courts. This admission is found in the July 13, 2010 Order http://fulldisclosure.net/Documents/YaffeMinuteOrder7-13-10.pdf
The second Order was dated June 18, 2010 but inexplicably filed some twenty-five days later on July 13, 2010 by the Los Angeles Court Clerk John Clark. http://fulldisclosure.net/Documents/LateFilingYaffeMinuteOrder7-13-10.pdf
