Kershaw, Cook & Talley Provides Litigation Updates for DePuy Pinnacle 2016 Trial

SACRAMENTO, Calif., Oct. 5, 2016 /PRNewswire/ -- Kershaw, Cook & Talley developed a website Pinnacle Hip Help as a resource center for individuals suffering as a result of their DePuy Pinnacle Hip Implant. The Pinnacle is a metal-on-metal hip that was discontinued in mid-2013 but has not been recalled. The FDA warns of dangers associated with metal-on-metal hip implants including the DePuy Pinnacle. There are presently several thousand lawsuits involving the Pinnacle pending in Dallas, Texas before Judge Ed Kinkeade.
On the website, attorney Stuart Talley publishes weekly videos discussing the latest events in the ongoing DePuy Pinnacle litigation. According to Mr. Talley, his firm developed the website to keep his clients and others up to speed on the litigation and how it is progressing.
Recently, Talley's updates are more frequent as the third bellwether trial began September 21, 2016. The trial involves the claims of six plaintiffs who are California residents. Unlike the other two bellwether trials, California law will apply to the plaintiffs' claims. According to Talley, this is significant, "Unlike the last bellwether trial where Texas law was applied, California has no caps on punitive or compensatory damages. In the previous trial, the jury awarded punitive damages but they were reduced from more than $300 million to approximately $20 million. That will not happen in this case."
In the pending Pinnacle cases, plaintiffs allege that Johnson & Johnson's subsidiary, DePuy Orthopaedics, knew about flaws in the Pinnacle's design that caused the release of cobalt and chromium into the hip joint. The plaintiffs assert that these metal particles caused a condition known as metallosis which then required revision surgery.
Patients with metal-on-metal hip implants, particularly the all-metal DePuy Pinnacle, should discuss their situation with a lawyer before it's too late to make a claim.
