There are currently over 70,000 cases relating to transvaginal mesh devices. Johnson & Johnson's Ethicon subsidiary currently faces about 33,000 mesh cases. Due to the high volume of cases, U.S. District Judge Joseph Goodwin is overseeing seven different multidistrict litigations (MDL) for filed cases against several mesh manufacturers. Ethicon is just one of the mesh manufacturers involved.
Ethicon has lost four cases already:
- In 2015, a California jury awarded a $5.7 million verdict against Johnson & Johnson's Ethicon subsidiary over their Gynecare TVT Abbrevo vaginal mesh device.
- In September 2014, a federal jury in West Virginia awarded $3.27 million to a woman plaintiff over the Ethicon Gynecare TVT mesh.
- In 2013, a jury in New Jersey awarded an $11 million verdict against Ethicon over their Gynecare Prolift.
- Also in 2013, in Texas state court, a woman was awarded $1.2 million against Johnson & Johnson.
Chris Janish, CEO of Legal-Bay, commented on the recent announcement of the upcoming trial, "While the other transvaginal mesh and bladder sling manufacturers have committed to at least partial settlements, J&J has been vehemently fighting settlement on these cases, even after at least four significant losses at trial worth several million dollars in each case. It is good to see a large batch of cases now going to trial in an effort to move this litigation forward more quickly so that some of the plaintiffs can hopefully see an end to their cases in the near future."
