Judge Grants Preliminary Injunction
Ruling says NCAE case likely to succeed
RALEIGH, N.C., May 16, 2012 /PRNewswire-USNewswire/ -- Today, North Carolina Superior Court Judge Paul Gessner granted a preliminary injunction on the override of Governor Bev Perdue's veto of SB 727, the NCAE payroll deduction bill.
NCAE President Sheri Strickland issues the following statement:
"This ruling should send a clear message to the General Assembly that their dead-of-night attempt to silence public school employees was wrong. Now is the time to have an open and honest debate about the negative impact budget cuts are having on our public schools. Trying to punish public school employees for speaking about what is best for students only undermines efforts to move North Carolina forward.
"Overcrowded classrooms with overworked and underpaid teachers hurt our state's economic future. Instead of trying to deny this fact, we should be working together to make sure our children receive the education they need to compete in the global economy. As long as there are issues that affect education, NCAE will be the voice that unites, organizes, and empowers members to be advocates for themselves, their schools, and the children we serve.
"We thank Superior Court Judge Paul Gessner for his ruling today and thank the hard work of our team of attorneys at Poyner Spruill, LLP, most notably NCAE's lead attorney, former state Supreme Court Justice Robert Orr and his assistant Drew Erteschik."
NCAE is the state's largest education association representing active, retired and student members.
