JERSEY CITY, N.J., Oct. 26, 2016 /PRNewswire/ -- Do you drive for Uber or Lyft in New Jersey? According to one personal injury attorney, you better watch out – your insurance may not cover you after an accident.
According to Jersey City attorney Anthony Carbone, because of the current insurance laws in New Jersey, many drivers who work for ride sharing programs like Uber may not know their insurance won't cover their medical bills after an accident.
"New Jersey is a no-fault insurance state," said Carbone of the Law Offices of Anthony Carbone. "This means if you are injured in a car accident, your insurance company will pay your medical bills. However, some policies have a loophole where your insurance can refuse to pay your medical bills if the vehicle you were using at the time of the accident was being operated for commercial purposes."
Both Lyft and Uber claim that they provide insurance coverage to all drivers; yet according to Carbone, this insurance does not cover medical expenses for injuries sustained while in the course of employment. This means the driver is the one who will be paying out of his/her own pocket if injured.
Unfortunately, motor vehicle accidents are on the rise. According to the 2015 data compiled by the National Highway Traffic Safety Administration (NHTSA), there was a 7.2 percent rise in fatal car accidents across the nation in 2015, from 32,744 to 35,092. This is the first increase in traffic fatalities in five decades; the last time there was such an increase was in 1966.
Carbone stresses that all drivers should know the specifics of your insurance plans, especially before you sign up to become a ride share driver. "Insurance coverage is something you need to consider before taking a job at a ride sharing program," said Carbone. "Make sure you examine your insurance policy carefully. Otherwise, expect a large medical expense coming your way if you get into a car accident while on the job."
