CHARLOTTE, N.C., Dec. 4, 2014 /PRNewswire/ -- Sick leave laws are gaining momentum across the country and human resource professionals need to ensure compliance as many come into effect in 2015. These emerging laws present some potential administrative headaches for employers, but comprehensive human capital management technology solutions that include both time and payroll make compliance easier.
Employers in San Francisco, New York City and Connecticut are already complying with a similar type of legislation, and mandates for the states of California and Massachusetts will be implemented in July 2015. The specifics of each law differ according to details such as caring for ill family members, carrying over sick leave from year to year, types of documentation required and other factors.
The Massachusetts law requires employers to provide workers with one hour of paid sick time for every 30 hours they work, to be capped at 40 hours total for the year. These workers can use the time for their own illnesses, injuries or medical conditions or when an immediate family member requires care. Employers with ten or fewer employees will be exempt from the paid sick leave requirement, but must allow workers to take unpaid leave under the same conditions.
The California law, called Healthy Workplace, Healthy Families Act of 2014, applies to all employers in the state, regardless of size, and all employees who are full-time, part-time and temporary (after 30 days) who work directly for the company rather than through an agency. The law also requires the sick leave accrual to be stated on itemized wage statements. The information sheet is required to be provided to all new, non-exempt employees and to those who have a pay or job change within seven days of that change. Unlike vacation time, sick leave accrual does not have to be paid out upon termination of employment, but sick leave accrual must be reinstated for any employee rehired within one year. Records of paid sick leave accruals and use must be kept for three years.
