NEW YORK, Nov. 17, 2017 /PRNewswire/ -- Johnson & Johnson and its DePuy Orthopaedics subsidiary have been ordered to pay $247 million to six plaintiffs who experienced the premature failure of a metal-on-metal version of the companies' Pinnacle Hip Replacement System. Yesterday's verdict in the U.S. District Court, Northern District of Texas, followed a 9-week trial and marked the defendants' third loss in a multidistrict litigation that includes more than 9,200 similar Pinnacle hip lawsuits. DePuy Pinnacle Hip Lawsuits
DePuy and Johnson & Johnson are facing more 9,700 lawsuits nationwide involving a version of the Pinnacle hip that utilizes the companies' Ultamet liner. The six plaintiffs involved in this latest trial were residents of New York, and all were forced to undergo risky revision surgery after their Pinnacle implants failed within just a few years of their initial hip replacement surgery. The defendants were accused of falsely promoting the devices as a more durable option for patients in need of hip replacement, despite design flaws that increased the risk of bone erosion, tissue necrosis, and other debilitating complications.
The Northern District of Texas concluded its first bellwether Pinnacle trial in October 2014, with the jury finding for Johnson & Johnson and DePuy. But three consecutive juries have since delivered verdicts in favor of plaintiffs.
The litigation concluded its second bellwether trial in March 2016, when five Pinnacle plaintiffs were awarded a total of $500 million. However, damages were reduced to $151 million to comply with Texas law governing punitive damages.
The litigation's third bellwether trial concluded last December, when $1 billion was awarded to six Pinnacle hip recipients. However, that verdict was reduced to $543 million.
This latest jury deliberated for just 14 hours before ordering the companies to pay the plaintiffs $79 million in actual damages and $168 million in punitive damages.
