CORPUS CHRISTI, Texas, Nov. 12, 2015 /PRNewswire/ -- Today Bob Hilliard filed suit against Volkswagen for violations of Texas law stemming from Volkswagen's emissions scandal.
There are approximately 3,000 affected vehicles in Bexar county and penalties for violations range from $50 to $25,000 per day of every violation.
Hilliard states, "Volkswagen has admitted that their vehicles released nitrogen oxide at levels that far exceed allowable standards. NOx is a contributor to ozone formation, which diminishes Bexar County's air quality--and VW's conduct is in direct violation of Texas law, which the counties have authority to enforce."
The Texas Water Code allows counties to file suit for violations of certain provisions of the Texas Health and Safety Code. The violations carry stiff fines--not less than $50 and not more than $25,000 for each day of each violation. VW has admitted that vehicles as early as 2009 were affected.
"Those violations add up," says Hilliard. "Not only in terms of the civil penalties likely to be levied against Volkswagen but also, and more importantly, in terms of the negative effects that Volkswagen's conduct had on residents on Bexar County who are force to live in and breathe contaminated air."
