Hilliard Responds To House Subcommittee's Report Regarding NHTSA's Failure To Recognize GM Safety Issue Years Ago
CORPUS CHRISTI, Texas, Sept. 16, 2014 /PRNewswire/ -- Bob Hilliard, a Texas lawyer and one of the nation's key players in the pursuit of claims against GM responds to the House Energy and Commerce Committee report which criticizes the National Highway Traffic Safety Administration (NHTSA) for failing to take action on the GM safety issue now linked to at least 19 deaths.
According to the report NHTSA's biggest failure involves the agency's handling of a fatal 2006 Chevy Cobalt crash in Wisconsin, which claimed the lives of two young girls, Amy Rademaker and Natasha Weigel and left one survivor, Megan Phillips, with life-long physical and emotional scars.
The investigation of that accident, conducted by a Wisconsin state trooper, determined that the likely cause of the non-deployment of the frontal air bags was tied to the vehicle's ignition being in the "accessory" position, yet NHTSA ignored this suggested link and "instead, focused on the circumstances of the crash based on outdated perceptions of how air bag systems functioned." In turn, this contributed to the years of delay in identifying the defect.
Bob Hilliard, who represents the families of Amy Rademaker and Natasha Weigel as well as, Megan Phillips states, "Today congress highlights a huge flaw in our governments regulation of the powerful automotive industry: NHTSA is outmanned, intimidated and incapable of reigning these companies in."
Hilliard, who currently represents 90 families of victims who were killed and over 1300 individuals who were injured in General Motors' defective vehicle, states "NHTSA has turned over the keys to the asylum to the inmates--allowing car companies to self-regulate, allowing the car companies to choose profits over safety, and allowing the car companies to tell NHTSA if and when an investigation and a recall should occur."
"There can be no doubt that GM took advantage of a weak and timid agency and ran rough shod over even NHTSA's most meger attempts to insist safety come first."
