Hilliard Munoz Gonzales Reports Texas Lawyer Files Lawsuit On Behalf Of 658 Plaintiffs
CORPUS CHRISTI, Texas, July 30, 2014 /PRNewswire/ -- Yesterday, Texas lawyer Bob Hilliard, one of the nation's key players in pursuing claims against General Motors for deaths and injuries caused by faulty ignition switches, filed a lawsuit on behalf of 658 individuals who were injured or killed in GM's defective vehicles.
Mr. Hilliard's lawsuit is filed in the United States Southern District Court of New York where the General Motors, LLC Ignition Switch Multi District Litigation (MDL) is currently pending and names 29 Plaintiffs who are bringing claims on behalf of individuals who were killed and 629 who were injured. "All of the victims' accidents occurred after the GM Bankruptcy and will not be subject to GM's attempts to shield itself from liability by asserting bankruptcy," Hilliard says.
Mr. Hilliard states, "This filing was made necessary, in part, by GM's restrictive eligibility requirements to their Compensation Fund. Ken Feinberg has no flexibility in this regard and must follow GM's instructions as to the make/model of the vehicles eligible. This makes absolutely no sense as the Fund is restricted to the first 2.6 million vehicles initially recalled for ignition switch issues but subsequently GM recalled an additional 17.3 million vehicles for the same problem. If you are unlucky enough to been in one of the 17.3 million vehicles and have suffered injury or death because of the defect, you are kicked out of the Fund. This is GM madness at its best."
"No vehicles or victims in any ignition switch vehicle recalled after the very limited first recall are allowed to participate in the Fund. This is nonsensical, mule-headed and absurd. GM needs to step up and acknowledge the blood on its hands from all of these recalled cars. Otherwise it is proving its critics correct and requiring these innocent victims to file lawsuits and utilized valuable court resources over a number of years."
Mr. Hilliard intends to request permission to bring in an additional 248 pre-bankruptcy cases including 21 death cases, 136 injury cases and 91 economic loss cases. "Not only is GM's attempts to hide behind this bankruptcy defense a moral mistake—given the conduct of GM and the number of families who have to visit graveyards thanks to this car company —it is certainly not a legal given that GM will be successful in its attempts to use this 'get-out-of-jail-free' bankruptcy card."
Mr. Hilliard has filed a request with Judge Furman to lead the MDL's national personal injury and death litigation.
The case is Abney, et al. v. General Motors, LLC, Case No. 14-cv-5810, in the Southern District of New York.
