Hilliard comments on Crime Fraud Ruling
CORPUS CHRISTI, Texas, Nov. 25, 2015 /PRNewswire/ -- Today Federal Court Judge Jesse Furman, who oversees the ongoing litigation against GM for its faulty ignition switches, entered an order denying Plaintiffs motion which sought to compel General Motors LLC, or New GM, and their counsel King & Spalding to produce documents under the crime-fraud exception to attorney-client communications and attorney work product.
Hilliard states, "GM's conduct is historic in its breadth and consequences. Thousands of injures, hundreds of deaths were caused by this ignition switch.
"There can be no doubt that there is probable cause to believe that New GM committed a crime or fraud by concealing the ignition switch defect from its regulators and the general public. In fact, as the Court points out in its Opinion: 'The recent criminal charges filed against New GM indicate there is probable cause to so believe, and Plaintiffs in this MDL may ultimately be able to prove that New GM committed egregious acts for which it should be held to account.'
"There is a reason that the almost impenetrable vaulted wall protecting the attorney client privilege is difficult to overcome. We believed that this case and these facts supported the defeat of the privilege. The Court disagreed. In January we will try the first case against GM, and the jury, through its verdict, will now directly speak to GM's behavior. That verdict will determine what level of financial punishment should be assessed against this company for its conduct."
