Heninger Garrison Davis, LLC Wins Appeals in Daniel Moore Case

ATLANTA, June 11, 2012 /PRNewswire/ -- Heninger Garrison Davis, LLC is proud to announce a favorable opinion for its client Daniel Moore and New Life Art in his case against  the University of Alabama.  The university claimed Moore's famous paintings of Alabama football scenes violated the school's trademark rights, while Moore said his paintings were protected by the First Amendment.  In 2009, a federal judge sided with Moore in regard to his paintings; however, he lost the right to produce mugs and calendars of the artwork.  Portions of this decision were appealed by both Alabama and Moore.  Today, the federal appeals court in Atlanta released their opinion on the appeals.

The 11th U.S. Circuit of Appeals upheld a district court's ruling that Moore's paintings and prints are protected by the First Amendment and reversed another ruling that previously prohibited Moore from selling calendars of his artwork. The court remanded the production of mugs and other "mundane products" to the district court for further proceedings. 

These rulings mean Moore will be allowed to continue creating and selling his paintings based on Alabama football.  Additionally, he will now be allowed to sell calendars featuring his artwork.  The production of mugs and other items will be decided by another court.  The University of Alabama could appeal to the U.S. Supreme Court.
