BOSTON, Oct. 22, 2014 /PRNewswire/ -- A recently published study in the New England Journal of Medicine from the RAND Corporation revealed that when the threat from malpractice lawsuits is removed, there was not a reduced rate of CT and MRI scans requested by doctors. The study concluded that the impact from the medical malpractice legislation did not reduce health care costs. It was previously argued that physicians routinely practiced "defensive" medicine, and it was lobbied that legislation was needed to change the malpractice standard. The RAND corporation research focused on the three states (Georgia, South Carolina, and Texas) that passed legislation making it difficult to initiate malpractice lawsuits. Rather than being able to plead a malpractice claim based on ordinary negligence, those wishing to file suit are required to prove gross negligence to be successful. Gross negligence indicates that the doctor knew a treatment would result in harm or serious injury and regardless of that knowledge proceeded anyway. The empirical data from the research concluded; "Although there was a small reduction in charges in one of the three states (Georgia), our results in aggregate suggest that these strongly protective laws caused little (if any) change in practice intensity among physicians caring for Medicare patients in emergency departments."
Often individuals (and their families) who were injured as result of a careless medical error are placed under emotional and financial strain. Those individuals that resided in states where limits on medical malpractice legislation have been enacted find it difficult to file a claim against those who were responsible. Bradley Braun of Pegasus Legal Funding stated; "There are no winners from this legislation, those patients harmed were prevented from seeking a legal remedy to make them whole and there have been no savings from any reduction in prescribed medical treatment."
