Guess Inc. urges the Superior Court of Montreal to transfer the litigation case Georges Marciano before the Federal Court of California

MONTREAL, May 6, 2015 Designer Georges Marciano filed two lawsuits against Guess. The first litigation concerns the violation by Guess Inc. of a contract mentioning Georges Marciano is free to use his name any way he wishes in retail or manufacturing venture. Indeed, Guess filed a statement of opposition against the trademark application "Royal Navy by Georges Marciano". The second litigation concerns the illegal use of the mention "Guess by Georges Marciano" whereas the license agreement was cancelled in 1993.

In the first case, Guess Inc. filed a motion alleging that this case has to be conducted before the Federal Court of California. Georges Marciano wants to continue these two cases either in Montreal or in Los Angeles.

On April 28, 2015, the Superior Court of Montreal also decided that the Canadian law firm Gowling Lafleur Anderson could continue to represent Guess Inc. even if they were the trademark agents who succeeded to register the Canadian trademark Georges Marciano in the 80s and 90s. Georges Marciano intends to file an appeal because of the confusion caused by the two rulings.
