Greenspoon Marder Encourages Congress To Act To Protect The Cannabis Industry From Unnecessary Prosecution Under Individual U.S. Attorneys
FORT LAUDERDALE, Fla., Jan. 4, 2018 /PRNewswire/ -- Greenspoon Marder is encouraging Congress to act quickly to protect states, cannabis businesses, and citizens from unnecessary and random criminal prosecutions at the whim of individual United States attorneys.
The drug war has failed, particularly as it relates to cannabis, and Jeff Sessions' decision is an attempt to reverse criminal and social justice reforms that have been empirically successful.
"Greenspoon Marder is disappointed that the DOJ has taken a position on enforcement that runs counter to strong public opinion as it relates to cannabis legalization," comments Gerry Greenspoon, Co-Managing Director of Greenspoon Marder.
We expect United States attorneys in states where voters or legislatures have implemented some form of legalization, whether it be medical or adult use, to respect the will of the voters in those states and not take enhanced enforcement actions.

Cannabis legalization has progressed too far to stop its momentum. The revocation of the Cole Memorandum cannot stop progress in the cannabis industry, which is driven by science, social justice, tax revenue, and economic opportunity, including tens of thousands of jobs. As, we say, the genie cannot be put back into the bottle.
We are hopeful that states will continue to protect those legally operating and the best course of action, unless other guidance is issued from state attorney generals, is to maintain strict compliance with all state laws.
