Governor Signs Kansas Auto Insurance Bills
TOPEKA, Kan., May 17, 2011 /PRNewswire/ -- Kansas Gov. Sam Brownback gave the OK to two pieces of legislation last week that will leave uninsured drivers with limited recovery rights and will ban cities from charging motorists and their car insurance companies for emergency response to accident scenes.
According to OnlineAutoInsurance.com, the "no pay, no play" legislation to limit uninsured motorists' recovery rights provides more reason for those without a policy in the state to conduct an auto insurance quotes comparison and get covered as soon as possible.
"No pay, no play" laws are already on the books in a handful of states and are being considered in a number of other state legislatures. These laws basically expand the repercussions for driving without insurance by erasing uninsured motorists' right to recover non-economic damages. That means they will still be able to successfully seek compensation from the at-fault party for economic damages like hospital bills and auto repair bills, but they will not be able to successfully seek compensation for non-economic damages such as pain and suffering.
The law does not extend to all drivers who lack coverage but, rather, only to those who have lacked a policy for at least 45 days and were not continuously insured during the year directly before that 45-day period.

"No pay, no play" laws have been heavily debated in a number of state legislatures, with opponents saying they level unfair consequences on those who cannot afford coverage and supporters saying they merely beef up the consequence for disobeying states' mandatory insurance laws.
The ban on emergency response fees is part of a backlash across the country to cities' trying to recoup expenses by charging motorists for the use of public services. It prohibits cities and other municipalities from charging motorists an arbitrary amount of money for dispatching police and firefighters to accident scenes. Two other states already banned the fees this year.
