In Case 9:14-cv-80190-DTKH Global Digital Solutions, Inc. v. Murphy, the United States District Court for the Southern District of Florida denied defendant Kett's motions to transfer the case to the United States District Court for the Northern District of Illinois and to dismiss GDSI's lawsuit against Kett alleging claims for tortious interference with contract (Count 1), fraudulent inducement to contract (Count 2), fraudulent concealment (Count 3) and civil conspiracy (Count 4)

(OTCQB:GDSI), a company that is positioning itself as a leader in providing cyber arms manufacturing and complementary security and technology solutions, today announced that the Company has won a significant victory in its lawsuit against Merriellyn Kett Murphy, former CEO and sole shareholder of Airtronic USA ("Airtronic").
On October 9, 2014 (Case 9:14-cv-80190-DTKH Global Digital Solutions, Inc. v. Murphy), the United States District Court for the Southern District of Florida denied all of defendant Merriellyn Kett Murphy's motions to transfer the case to the United States District Court for the Northern District of Illinois and to dismiss GDSI's lawsuit against Kett individually alleging claims for:
- Count 1: Tortious interference with contract and advantageous business relationship (interference with the Airtronic/GDSI Merger Agreement);
- Count 2: Fraudulent inducement to contract (inducing GDSI to loan money based on false representations regarding Airtronic's intent to proceed with the merger);
- Count 3: Fraudulent concealment (failing to advise GDSI of her ongoing discussions with other prospective merger partners; and
- Count 4: Civil conspiracy.
As a result of the Court's decision, GDSI's lawsuit against Kett individually will go to trial in Florida. A scheduling order is expected shortly setting the tentative trial date.
