YAKIMA COUNTY, Wash., Oct. 12, 2015 /PRNewswire/ -- A former Selah Junior High School student filed a lawsuit against her former 8th grade teacher, David McMillen, for secretly videotaping underneath her desk in a classroom on multiple occasions. She has used a pseudonym in the lawsuit to protect her privacy.
In October of 2011, after a student discovered a camera underneath a desk, a school investigation revealed that McMillen had installed numerous cameras throughout his classroom. Although McMillen attempted to destroy much of the evidence, law enforcement intervened and was able to prevent the destruction of key evidence which led to his conviction for voyeurism. He is now serving a 28 month prison sentence. The student's lawsuit, filed in Yakima County Superior Court, and McMillen's Felony Judgment and Sentence, are attached.
During the police investigation but before his conviction in Yakima, McMillen moved to King County, where he secretly videotaped children in parks, and also secretly videotaped himself in sexual encounters with young women without their knowledge. He pleaded guilty to voyeurism charges regarding these incidents.
According to Tamaki Law attorney Bryan G. Smith, "When a teacher breaches the trust of parents and students, and violates a child's privacy to this degree, the teacher needs to be held fully accountable. A betrayal of this kind causes permanent harm to children, and my client will never be the same. David McMillen targeted my client for his own sexual gratification in an environment which is supposed to be safe and nurturing. This is about holding him accountable for his reprehensible behavior as a teacher."
