Folk & Associates, P.C. To Join Clark Hill PLC

PHOENIX, Sept. 17, 2013 /PRNewswire/ -- The attorneys and staff of Phoenix-based Folk & Associates, P.C. will join Clark Hill PLC effective September 16, 2013, Clark Hill Arizona Managing Member Darrell Davis announced today.

Folk is a vigorous advocate for the industry. He wrote Arizona's certificate of merit statute—which raised the bar for professional liability lawsuits—and a complete re-write of Arizona's indemnity laws for public works projects that took effect this month. His latest legislative effort cured long-standing problems with unfair and uninsurable contracts for government work. Folk has also written precedent-setting amicus briefs filed with Arizona's Supreme Court in major cases involving the economic loss doctrine, limitation of liability, the statute of repose, and construction defect litigation.

In addition to Folk, who joins as a Member, attorneys Christopher D.C. Hossack and James B. Wright join as Senior Counsel and Heather K. Seiferth joins as an Associate attorney.

Hossack has a distinguished record in the defense of design professionals in wrongful death and catastrophic injury cases. In recent years he successfully defended a national engineering firm against a real estate developer's $95 million professional liability claim. He also defended another client in a catastrophic injury case arising from the crash of a light plane at a general aviation airport. That litigation also involved a professional negligence claim against an engineering professional.

Wright has an active corporate and transactional practice. He has prepared design and construction documents for destination resorts, a $143 million design-build manufacturing project, and mixed use commercial projects. His past experience also includes representation of financial institutions in complex commercial loan transactions.

Seiferth has collaborated with Folk on his legislative and amicus work, and she is a rising star in the firm's trial and appellate practice.
