MESA, Ariz., Oct. 5, 2016 /PRNewswire/ -- A Palm Beach County Court has sided with the city of Boynton Beach in a red-light safety camera violation dispute. In its ruling issued on Sept. 30, the 15th Judicial Circuit Court for Palm Beach County rejected the driver's argument that his ticket should be dismissed because the city inappropriately relinquished police powers to the program's vendor, American Traffic Solutions (ATS).
"The City's contract with ATS specifically establishes that ATS does not and cannot make any decisions regarding whether a violation occurred," the Court stated in its ruling.
This summer, Florida's Third District Court of Appeal, heard a similar argument in City of Aventura v. Jimenez and reached a similar conclusion. In the Jimenez ruling the court took a closer look at the restrictions Aventura placed on its third-party vendor through agreements and business rules. The court found Aventura's program was operating within the law with its vendor, ATS.
"This latest decision once again affirms the role of American Traffic Solutions and other vendors in the state of Florida when partnering with communities to implement red-light safety camera programs," said ATS State and Local Government Solutions General Manager, Liz Caracciolo.
Florida's Mark Wandall Traffic Safety Act passed in July 2010, established standard guidelines for red-light safety camera programs in Florida. Currently, several communities in Florida partner with ATS for their red light safety camera programs. Rigorous independent studies show red-light safety cameras effectively reduce dangerous right-angle intersection collisions by changing driver behavior.
Most recently, an analysis by the Insurance Institute for Highway Safety (IIHS) found that red light safety camera programs in 79 large U.S. cities saved nearly 1,300 lives through 2014.
