WILMINGTON, Del., Nov. 20, 2018 /PRNewswire/ -- Fish & Richardson has won two jury verdicts in Delaware federal court for client Power Integrations, Inc. in its latest patent infringement battles against Fairchild Semiconductor. On November 9, 2018, a jury found that Fairchild induced infringement and willfully infringed two patents for technology used in power supply controller chips, awarding $24.2 million in damages.
The case was a retrial on inducement; in 2012, a different jury found Fairchild liable for direct infringement and inducement, but the Federal Circuit vacated the inducement portion of the verdict in December 2016. In addition to the inducement question, the jury in this trial was focused on the issues of willfulness and damages.
On November 15, 2018, in a separate patent trial, another jury found that Fairchild induced infringement of another Power Integrations patent and awarded damages.
Fish principal Frank Scherkenbach led the first trial, and Joseph Warden the second, with support from Fish principals Howard Pollack, Michael Headley, Doug McCann, and Neil Warren.
Fish has represented Power Integrations against Fairchild and related entities since 2004, securing victories in a series of cases in a number of venues, including obtaining injunctions against over 175 infringing Fairchild products. Over the course of the litigation, courts have repeatedly affirmed the validity of Power Integrations' patents. Other victories include verdicts against Fairchild in 2006, 2014, and 2015 (all "Top 100 Verdicts" of the year), and victories at the ITC and the Federal Circuit.
