BOSTON, March 14, 2017 /PRNewswire/ -- Fish & Richardson today announced that it has been named the top patent litigation defense firm in the U.S. by Lex Machina in its recent Patent Litigation Year in Review. The report showed that Fish represented defendants in 160 new patent cases last year – nearly 100 more patent cases than the next-busiest defense firm. Fish is one of only three firms appearing on both the top firms representing plaintiffs and top firms representing defendants lists. Overall, Fish filed appearances in 189 new cases, compared to 69 cases for the second-ranked firm.
According to Lex Machina's data, only 66 of the 491 patent cases that were concluded in 2016 went to trial. Fish handled 11 of those 66 cases, or 17% of all patent cases that went to trial.

The report also found that the Eastern District of Texas continues to lead the nation by number of new cases filed in 2016 with 1,662 cases. An earlier Lex Machina report showed that Fish is the most active law firm in the that court, handling 937 cases from 2006-2015, which is 553 more than the next-ranked firm. The District of Delaware maintained its place as the second top district for new case filings in 2016, and continued to be the top district for new ANDA cases filed, with 151 cases in 2016. Fish is among the leading firms handling patent cases in this important jurisdiction, and has filed over 200 ANDA patent cases in the District of Delaware since January 2011.
Lex Machina's research also showed that the number of Section 337 investigations at the International Trade Commission (ITC) rose in 2016 to 54 investigations, up from 36 cases in 2015. Fish is handling 11 of those 54 investigations or 20% of all active patent cases at the ITC, more than any other national firm.
