Ferris Mfg. Corp., Manufacturer of PolyMem® Wound Dressings, Settles Lawsuit Against Curaline, Inc.

CHICAGO, Sept. 1, 2016 /PRNewswire/ -- Ferris Mfg. Corp., the Fort Worth, Texas-based manufacturer and distributor of PolyMem® wound dressings, announced today that it has settled a federal lawsuit against defendants Curaline, Inc., and Curaline executive Roy Carr of Burr Ridge, Ill. The lawsuit, which alleged breaches of fiduciary duties and contract by Carr and false designation of origin by Curaline, was filed in the United States District Court for the Northern District of Illinois.

Carr works for Curaline, Inc., a Burr Ridge-based wound care manufacturer and competitor of Ferris, which relocated to North Texas from Illinois in 2012. Before joining Curaline, Inc., Carr was a core member of Ferris' upper management and was privy to Ferris's highly confidential business, financial and legal strategies.

In its lawsuit, Ferris alleged that Carr had agreed to protect Ferris's confidential information and assigned all inventions to Ferris, breached his employment contract and misappropriated Ferris confidential knowhow immediately after he left Ferris.

Ferris further alleged that Carr misappropriated its confidential information and conveyed this information to Ferris' competitor Curaline, which thereafter began to market wound dressings.

Curaline's Chief Executive Officer is Haitham Matloub. Upon learning that Carr had joined Curaline, Ferris's counsel advised Matloub of Carr's ongoing duty to keep confidential Ferris's proprietary information. Ferris alleged that Matloub and Curaline ignored this warning.

The terms of the settlement agreement are confidential.
