Expanded Statement from The Murnaghan Family Regarding Judge Michael M. Baylson's Ruling, June 5, 2013
PHILADELPHIA, June 5, 2013 /PRNewswire/ -- Effective immediately, Judge Michael Baylson has granted a 10-day temporary restraining order (TRO), instructing Secretary Sebelius of Health & Human Services (HHS) to direct OPTN to cease application of the under 12 rule as to Sarah. If there is another child in this judicial district in Sarah's circumstance, he will consider and probably grant a TRO for them if presented to him in court. The judge set the preliminary injunction hearing for June 14.
For us, this means that for the next 10 days, Sarah's placement in the queue for adult lungs will be based on the severity of her illness, and she will not be penalized for her age. Her current LAS score—the measure used to measure illness-- is a 78.
We are experiencing many emotions: relief, happiness, gratitude and, for the first time in months: hope.
