Eric Goode's B Bar and Grill Accused of Labor Violations, According to Workers' Legal Team
NEW YORK, Jan. 13 /PRNewswire/ -- A lawsuit filed Tuesday alleges that restaurateur and hotelier Eric Goode's B Bar and Grill in New York violates federal and state labor laws, according to Outten & Golden LLP.
Four current and former employees, who worked as cooks, dishwashers, and bussers, at Goode's restaurant at 40 East 4th Street allege violations of the federal Fair Labor Standards Act (FLSA) and the New York Labor Law (NYLL).
Justin M. Swartz, Rachel Bien, and Delyanne Barros, of Outten & Golden LLP represent the workers, and will seek to have the lawsuit certified as a class action intended to recover, among other things, minimum wages, overtime, spread-of-hours pay, and uniform-related expenses for workers who have been employed since 2004.
Attorney Rachel Bien stated, "B Bar and Grill's prominence among 'New York's fashionable crowd' has come at the expense of the cooks, dishwashers, servers, bussers and runners who have helped make the restaurant a 'downtown institution' for many years."
Attorney Delyanne Barros stated, "We hope that this lawsuit will convince Mr. Goode's hospitality enterprise and B Bar and Grill to change their policies and practices. Like all other workers, restaurant workers deserve to be paid all of the wages they are due, including overtime at time and a half, and not just at the straight-time rate."
The defendants are Eric Goode, Garden Cafe Associates L.L.C., and Sulcata Corp. In addition to B Bar and Grill, Goode co-owns and/or operates several prominent restaurants and bars, including the Park, Waverly Inn, the Lobby Bar at the Jane Hotel, the Gemma at the Bowery Hotel, and La Botega and Matsuri at the Maritime Hotel.
The case is "Luis Campos, Arnoldo Molina, Gonzalo Vidanos, and Jose Garcia, et al., v. Eric Goode, et al.," U.S. District Court, Southern District of New York, Case No. 10 Civ 0224.
The plaintiffs are Luis Campos, of Queens, N.Y.; Arnoldo Molina, of New York, N.Y.; Gonzalo Vidanos, of Queens, N.Y., and Jose Garcia, of New York, N.Y.
