Elements Behavioral Health Announces Dismissal of Seabrook House Lawsuit
Lawsuit filed by Seabrook House against Elements Behavioral Health has been dismissed with prejudice and without a financial settlement.
LONG BEACH, Calif., March 10, 2015 /PRNewswire/ -- Elements Behavioral Health announced today that a lawsuit by Seabrook House last year alleging trademark infringement and related claims regarding online marketing content has been dismissed with prejudice and without a financial settlement.
The dismissal of the lawsuit, which was also brought against Recovery Brands, is consistent with Elements' position that the claims asserted by Seabrook House were without merit. Elements Behavioral Health adheres to the highest ethical digital marketing principles consistent with its commitment to responsible online advertising. Elements continually audits its websites and those of its advertising partners and monitors the performance of its call center representatives for adherence to the company's established standards and protocols.
"Through our online marketing campaigns, continuing education programs, publications and community events, we are committed to providing consumers the information they need to make important treatment decisions," said David Sack, MD, CEO of Elements Behavioral Health. "We believe it is time for all members of our industry to move beyond rushing to conclude that something unethical has occurred just because a treatment center has developed robust online advertising campaigns that reach a broad audience of potential clients and their families."
While Elements Behavioral Health is pleased with the outcome of this case, it is disappointed that Seabrook House chose to file this unsuccessful lawsuit rather than work with the company to address their concerns.
"We have the greatest respect for Seabrook's programs and have strongly supported Seabrook over the last several years through charitable contributions to the Seabrook Foundation and the numerous referrals we've made to their programs," said Dr. Sack. "It is uncertain how the parties' understanding in the settlement agreement that neither party will include a listing of the other in any websites owned or operated by the other will impact this support going forward. With this lawsuit put to rest, it is our hope that we can gradually return to a mutually respectful and beneficial relationship."
The Elements Behavioral Health management team encourages industry colleagues to contact them if they have any concerns regarding its websites or business practices, and will continue to work collaboratively with other providers within the treatment community.
