Dress Designer Sherri Hill Favorably Settles Second Copyright Infringement Lawsuit
LOS ANGELES, July 26, 2011 /PRNewswire/ -- Sherri Hill, distinguished and successful designer of high quality prom dresses and evening gowns, today announced that she favorably settled a second federal copyright infringement lawsuit, this one against Nox Anabel, Inc., a Los Angeles-based wholesaler.
Under the terms of the settlement, Nox Anabel will pay Sherri Hill sixty thousand dollars ($60,000), and must immediately hand over for destruction its entire inventory of six dress styles that Sherri Hill had alleged violated her intellectual property rights. Further, if Nox Anabel's employees make any commercial use of Sherri Hill's name in their sales pitches, the company can be subject to serious sanctions for contempt of court.
The lawsuit, which was filed last year in Los Angeles federal court by the New York-based brand protection law firm the Gioconda Law Group PLLC, had alleged that Nox Anabel had copied a distinctive and copyrighted bead design owned by Sherri Hill, and that Nox Anabel's employees were describing several of their dresses as "Sherri Hill designs." Sherri Hill had offered the testimony of a licensed private investigator to support the allegations, but Nox Anabel denied any wrongdoing.
Last year, Sherri Hill announced a settlement of a first copyright infringement lawsuit that it had brought against Let's Fashion, another Los Angeles-based dressmaker.
