Warner was implanted with one of Wright Medical's hip transplant products, the Profemur R implant. The implant fractured in 2010 and resulted in the need for numerous revision surgical procedures. The award consisted of $4 million for past and future pain and suffering and $500,000 to Warner's wife for loss of consortium. The jury found that although Wright Medical was not negligent in designing the implant, the defect occurred during the manufacturing process. More specifically, that the implant broke due to being weakened by a laser in the manufacturing process. Wright Medical is expected to appeal the verdict.
This case was the first to go to trial out of nearly 1,200 pending cases involving Wright Medical Technology Inc.'s metal hip implants.
