In February 2010, as a result of the HITECH Act, business associates were required to comply with the HIPAA Security Rule and some of the provisions included in the HIPAA Privacy Rule. However, the Office for Civil Rights held off on any enforcement activities – until now. With the recent re-definition of business associates expanded to "downstream" entities and the September 23, 2013 deadline to update BAAs looming, many organizations are finding themselves in new and possibly dangerous territory.
