PALM BEACH GARDENS, Fla., Sept. 30, 2015 /PRNewswire/ -- The U.S. Court of Appeals for the Federal Circuit earlier this month issued another key ruling in favor of Crossmatch™, affirming the International Trade Commission's (ITC's) determination that Korean fingerprint scanner company Suprema and its U.S. partner Mentalix violated Section 337 of the Tariff Act of 1930, a trade provision that declares it unlawful to engage in "unfair practices" in connection with import trade, by infringing two of Crossmatch's patents, the 5,900,993 patent and the 7,203,344 patent.
Crossmatch General Counsel Kathryn Hutton said, "We are pleased with the Federal Circuit's ruling and the fact that our patents have been upheld. We believe these decisions send a strong message to other potential infringers."
The Federal Circuit not only upheld the ITC's finding that Mentalix directly infringed Crossmatch patent '344, but that "Suprema performed market research on its competitors' patents and products, then actively encouraged Mentalix's activities while willfully blinding itself to the infringing nature of those activities." Crossmatch successfully obtained exclusion and cease and desist orders from the ITC against Suprema's infringing devices.
