- A healthcare or insurance company is purchasing medical practice groups and giving the physician full replacement value for their medical equipment or office furniture even though the personal-property has been fully depreciated.
- A healthcare or insurance company is overpaying for a medical practice group-based on future business/admissions as opposed to the revenue being currently generated by the medical practice group.
- A pharmaceutical company offers put a physician on 'speakers tour' as long as they continue to prescribe certain drug products at high volumes. Frequently these 'speaker fees' include expensive trips that include airfare, luxury hotels, and four-star dining.
In July of 2016 the Department of Justice announced a healthcare provider had agreed to pay $17 million to resolve allegations that it violated the Physician Self-Referral Law (the Stark Law) and the False Claims Act by maintaining improper financial arrangements with 28 physicians.
The United States alleged that the healthcare provider entered into asset purchase agreement for the acquisition of physician practices or employment agreements with 28 physicians that violated the Stark Law because the healthcare company took-into-account the volume or value of physician referrals, were not commercially reasonable or provided compensation in-excess of fair market value.
In this instance-the whistleblower received approximately $4.5 million.
